These terms and conditions apply to every offer, treatment and transaction between the nail stylist and a client to which the nail stylist has declared these terms and conditions applicable, insofar as the parties have not deviated explicitly and in writing from these terms and conditions.
2. Nail stylist best efforts
The nail stylist will perform the treatments with the best intention and effort and according to the requirements of good craftmanship and based on the at that moment available scientific knowledge.
The nail stylist will as far as reasonably possible, inform the client of the financial consequences of changes or additions to the agreed treatment.
When the client is unable to keep to the appointment, the nail stylist must be informed as soon as possible, but no later than 24 hours prior to the appointment.
If the client does not, or not timely, fulfil this obligation, the nail stylist may charge the client 50% of the fee for the agreed treatment.
If the client arrives at the agreed location more than 15 minutes later than the agreed time, the nail stylist may reschedule the appointment to another date/time.
This out of respect for the client who comes after you.
The nail stylist must notify the client as soon as possible about her own absence, but no later than one working day prior to the appointment.
Both parties do not have to comply with these obligations if they are hindered by force majeure.
Force majeure is what the law and jurisprudence say about it.
The nail stylist mentions all prices of treatments and products visible on the website.
The mentioned prices include btw.
The nail stylist will mention price changes clearly visible on the website 30 days prior to the starting date.
Offers in advertisements are valid during the indicated period and/or while stock lasts.
The client must pay for the treatment and any products in cash or payment request immediately afterwards.
5. Personal data & privacy
Prior to the first treatment, the client provides the nail stylist with all information, of which the nail stylist indicates that these are necessary, or of which the client should reasonably understand that these are necessary for the careful execution of the treatments.
The nail stylist records the client's personal data in an automated system and/or on a customer card.
The nail stylist treats the confidential data of the client according to the guidelines in the Personal Data Protection Act.
The nail stylist will not sell or rent data of the client to third parties without prior written permission from the client.
The nail stylist is obliged to keep confidential all private information communicated by the client during the treatment.
Information is considered confidential if this has been communicated by the client, or if this arises from the nature of the information.
The confidentiality ends if, based on a legal provision or a court decision, the nail stylist is obliged to provide the confidential information to third parties.
The nail stylist is not liable for damage, of whatever nature, caused by the nail stylist based on incorrect and/or incomplete information provided by the client about relevant physical disorders, use of medication, work, or leisure activities.
The nail stylist is not liable for loss, theft, or damage to personal belongings of the client.
The nail stylist gives the client a week (7 days) guarantee on the treatment and the products.
This guarantee will end if:
• The client does not complain within 24 hours by means of a message with photo.
• The client has had the (artificial) nails set before or maintained by another nail stylist.
• The client has worked with aggressive chemicals without wearing gloves.
• The client has 4 or more damaged nails.
• The client has bitten off or broken off the nails deliberately.
• The client has used other products than recommended by the nail stylist for the maintenance of the nails.
• The client has not followed the recommendations for home care of the nails.
• The client has not followed the advice to seek medical attention within 5 working days.
• The client has not used the products in accordance with the instructions.
9. Social media & publications
If the client has the applied nail polish or nail art photographed for commercial use, permission must be requested from the nail stylist in advance.
The nail stylist may demand a reasonable fee for this in addition to mentioning the nail stylist by name.
For the use of photos of the client to promote the nail stylist, verbal permission from the client will always be requested.
10. Damage & theft
The nail stylist has the right to claim compensation from the client if the client damages furniture, equipment, or products.
The nail stylist always reports theft to the police.
If the client has a complaint about the treatment or a product, this must be reported in writing to the nail stylist as soon as possible, but within 2 working days after discovery.
The nail stylist must give the complainant an adequate answer within 5 working days.
If a complaint is justified, the nail stylist will execute the treatment again as agreed, unless the client does not want this and makes this known in writing.
If the nail stylist and complainant cannot come to an agreement, the complainant can submit the dispute to the legislator or mediator.
12. Nail art
If the nail stylist or client shows an example of a nail art design to be applied, this is only an indication. The result on the client's nails does not have to be identical to the example given.
The copyright on applied nail art motifs rests with the nail stylist.
13. Good behaviour
The client should behave properly during the treatment according to generally accepted standards.
If the client continues to display improper behaviour after repeated warnings, the nail stylist has the right to stop or refuse treatment of the client without giving reasons.
14. House rules
The client should adhere to the visitor/house rules during the treatment.
The nail stylist applies the following house rules:
• Smoking is not allowed during the treatment.
• Consuming food is not allowed during the treatment, drinking is excluded.
• It is desirable to keep pets away during the treatment.
All treatments are only executed on persons aged 18 and older, unless written permission has been obtained from the parents/guardians.
15. Corona prevention
Extra measures related to corona prevention for contact professions..
The nail stylist is obliged to write down the contact details.
Wearing a mouth mask is mandatory during treatment.
In addition to this the nail stylist will be wearing gloves, and the client washes their hands thoroughly before the treatment.
In case of any form of cold, fever or other symptoms of corona, the client will be requested to reschedule the appointment (force majeure). This expectation goes both ways.
Dutch law applies to every agreement between the nail stylist and the client.
In the event of an explanation of the content and scope of these general terms and conditions, the Dutch text will always be decisive.
The most recently filed version, or the version that applied at the time of the conclusion of the agreement, will always apply.
